Wastewater Enforcement: Missouri Department of Natural Resources Abatement Order on Consent Addressing Municipality of Clever

The Missouri Department of Natural Resources (“MDNR”) issued a July 9th Abatement Order on Consent (“Order”) to the City of Clever, Missouri addressing alleged violations of the Missouri Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. See Order No. 2026-WPCB-1914.
The Order provides that Clever is a fourth-class municipality and operates a wastewater treatment facility.
The facility is located in Christian County, Missouri. It discharges treated effluent to Spring Creek subject to the conditions and requirements of a of Missouri State Operating Permit.
The Order alleges the following violations:
- Caused pollution of Spring Creek and its tributaries, waters of the State, or placed or caused or permitted to be placed a water contaminant, domestic wastewater, in a location where it was reasonably certain to cause pollution of Spring Creek and its tributaries.
- Failed to comply with effluent limitations for Aluminum, Ammonia as Nitrogen, E. coli, pH, and Phosphorus.
- Failed to submit complete, accurate, and timely Discharge Monitoring Reports.
- Failed to submit complete, accurate, and timely I&I and Sludge reports.
- Failed to submit complete, accurate, and timely progress reports.
Without admitting liability or fault, Clever agrees to pay an administrative penalty of $15,999. However, the penalty is reduced to $12,799 based on compliance with the penalty reduction offer conditions established in the transmittal letter sent with the Order.
The Order requires Clever to undertake certain measures to address the alleged violations pursuant to a schedule.
