The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and New Five Star Enterprise LLC (“Five Star”) entered into an April 16th Consent Administrative Order (“CAO”) addressing an alleged violation of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. The CAO provides that Five Star operates a wastewater treatment facility in Crittenden County, Arkansas.
The facility operates pursuant to an NPDES Permit. Further, it is stated to discharge treated domestic and truck stop wastewater to an unnamed ditch, which eventually flows to the St. Francis River. Such discharge is authorized pursuant to the NPDES Permit.
The CAO alleges that the facility failed to submit a complete permit renewal application at least 180 days before the expiration date of the NPDES Permit. To date, a permit renewal application has not been submitted.
The CAO requires that Five Star submit on or before the effective date of the CAO a complete permit renewal application to ADEQ. Further, the facility is required to comply with the existing NPDES Permit until the effective date of the renewal permit or the effective date of the permit termination.
A civil penalty of $1,000 is assessed, which could have been reduced to $500 if the document was signed and returned to ADEQ within 30 calendar days of its receipt.
