Wastewater Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and City of Stuttgart Enter Into Consent Administrative Order

The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and the City of Stuttgart, Arkansas entered into a May 22nd Consent Administrative Order (“CAO”) addressing an alleged violation of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. See Case #: CAO-26-0020.
The CAO provides that Stuttgart operates a publicly owned treatment works in Arkansas County, Arkansas.
The facility operates pursuant to NPDES Permit. Municipal wastewater is discharged to an unnamed ditch which eventually flows to the Arkansas River.
The CAO alleges that Stuttgart failed to submit a complete permit renewal application at least 180 days before the expiration date of the NPDES Permit, violating Part III.D.10.
Stuttgart is required to comply with the current NPDES Permit until the effective date of the renewal permit or the effective date of the permit termination. Further, on or before the effective date of the CAO, Stuttgart is required to submit a complete permit renewal application to ADEQ.
A civil penalty of $1,000 is assessed.
