Wastewater Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and City of Monette Enter into Consent Administrative Order

The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and City of Monette, Arkansas entered into a March 19th Consent Administrative Order (“CAO”) addressing an alleged violation of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. See Case #: CAO-26-0024.
The CAO provides that Monette operates a publicly owned treatment works located in Craighead County, Arkansas.
The facility is stated to have been issued an NPDES Permit.
Municipal wastewater is stated to be discharged from the facility to Little Ditch No. 3 and eventually to the St. Francis River.
The CAO lists the following violation:
- Failure to submit a complete permit renewal application at least 180 days before the expiration date of the permit in violation of Part III.D.10 of the Permit.
The CAO requires that Monette comply with the current Permit until the effective date of the renewal permit or the effective date of the permit termination.
A civil penalty of $1,000 is assessed, which could have been reduced by one-half if the document was signed and returned to ADEQ within 20 calendar days of its receipt.
