Wastewater Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and City of Holly Grove Enter Into Consent Administrative Order

The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and City of Holly Grove, Arkansas entered into an April 16th Consent Administrative Order (“CAO”) addressing an alleged violation of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. The CAO provides that Holly Grove operates a publicly owned treatment works (“POTW”) located in Monroe County, Arkansas.
The POTW is stated to discharge treated municipal wastewater to Dial Creek which eventually flows to the White River. Such discharge is authorized pursuant to an NPDES Permit.
Holly Grove is alleged to have failed to submit a complete permit renewal application at least 180 days prior to the expiration of the NPDES Permit. A complete permit renewal application was due by June 3, 2025. To date, Holly Grove is stated to have not submitted a permit renewal application.
The CAO provides that on or before the effective date of the document that Holly Grove must submit a complete permit renewal application to ADEQ. Further, the POTW must comply with the current Permit until the effective date of the renewal permit or the effective date of the permit termination.
A civil penalty of $1,000 is assessed which could have been reduced to $500 if the CAO was signed and returned to ADEQ within 20 calendar days of its receipt.
