Wastewater Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and City of DeValls Bluff Enter Into Consent Administrative Order

The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and City of DeValls Bluff, Arkansas (“District”) entered into a May 22nd Consent Administrative Order (“CAO”) addressing an alleged violations of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. See Case #: CAO-25-0147.
The CAO provides that DeValls Bluff operates a publicly owned treatment works located in Prairie County, Arkansas.
The facility operates pursuant to an NPDES Permit. Such Permit authorizes the discharge of treated municipal wastewater to the White River.
The CAO alleges that DeValls Bluff failed to submit a complete permit renewal application at least 180 days prior to the expiration of the NPDES Permit. To date, DeValls Bluff is stated to have not submitted a permit renewal application.
The CAO requires that on or before the effective date of the document that DeValls Bluff must submit a complete permit renewal application to ADEQ. Further, it must comply with the current Permit until the effective date of the renewal permit or the effective date of the permit termination.
A civil penalty of $1,000 is assessed.
