The Borough of Plum, Pennsylvania (“Plum”) filed an April 2nd Petition for Review (“Petition”) before the United States Environmental Protection Agency (“EPA”) Appeals Board (“EAB”) of a UIC Class II-D Permit (“Permit”) issued to Penneco Environmental Solution, LLC (“PES”).
The Petition states that EPA issued the Permit authorizing PES to operate a Class II-D injection well at a proposed site in Plum.
The Petition states that PES intends pursuant to the referenced Permit to reinject recovered brine from oil and gas operations. The reinjection would be for purposes of disposal into the proposed injection well. The Permit is stated to authorize PES to convert an existing Sedat #3A into a Class II-D commercial brine disposal injection well.
The Petition ‘s primary argument challenging the Permit conditions is stated as follows:
The Permit allows the injection of materials that cause an increase in seismic activity which directly threatens underground sources of drinking water, without the Permit requiring proper safeguards and monitoring of seismic activity.
