The United States Environmental Protection Agency (“EPA”) and American Indian Environment and Health Association, d/b/a AIEHA (“AIEHA”) entered into a November 17th Consent Agreement and Final Order (“CAFO”) addressing alleged violations of 40 C.F.R. Part 745, Subpart L, Lead – Paint Based Activity Requirements.
The CAFO describes AIEHA as a non-profit business in good standing under the laws of the State of Kansas.
AIEHA is stated to be a “training provider” as defined in 40 C.F.R. § 745.223 and acted as such during “initial renovator training” sessions held on January 25, 2013 and May 11, 2013. The CAFO further states that on February 21, 2014, pursuant to Section 11 of the Toxic Substances Control Act, a representative of EPA conducted a record keeping inspection of AIEHA’s records to determine compliance with the Lead-Based Paint Activities Rule.
AIEHA is alleged to have failed to notify EPA of planned training activities as required by 40 C.F.R. 745.225(c).
The CAFO further provides in part:
At the time of the EPA inspection, it was discovered that Respondent failed to notify EPA of all lead-based activities courses offered at least 7 business days prior to the start date of any lead-based paint activities course, which is a violation of 40 C.F.R. § 745.225(c)(13)(i).
The CAFO provides that AIEHA neither admits nor denies the factual allegations.
AIEHA agrees to a mitigated civil penalty of $1,848.00.
