Tire/Hazardous Waste Enforcement: Louisiana Department of Environmental Quality and Gibson Salvage Yard Enter into Settlement Agreement

The Louisiana Department of Environmental Quality (“LDEQ”) and Modern American Recycling Service, Inc. (“MARS”) entered into a June 4th Settlement Agreement (“SA”) addressing alleged violations of the Louisiana waste tire and hazardous waste regulations. See Settlement Tracking No. SA-MM-26-0028.
The SA provides that MARS owns and/or operates a salvage yard in Gibson, Louisiana.
The facility is stated to constitute a:
- Waste Tire Generator.
- Small Quantity Generator of Hazardous Waste.
LDEQ is stated to have conducted inspections at the facility in 2017-2018.
The following violations were allegedly identified:
- Failure to determine if a solid waste is a hazardous waste.
- Failure to provide cover adequate to exclude water from waste tires.
- Failure to store waste tires indoors in a transportable container.
- Storage of waste tires for longer than 365 days after receipt or generation.
MARS denies it committed any violations or that it is liable for any fines, forfeitures, and/or penalties.
A civil penalty of $40,000 is assessed.
