Stormwater Enforcement/Wastewater Enforcement Mississippi Commission on Environmental Quality and Kosciusko Structural Steel Manufacturing Facility Enter Into Agreed Order

The Mississippi Commission on Environmental Quality (“MSEQ”) and Attala Steel Industries, LLC (“ASI”) entered into a May 20 Agreed Order (“AO”) addressing alleged violations of the Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) Permit. See Order No. 7710 26.
The AO provides that ASI operates a facility in Kosciusko, Mississippi.
ASI is stated to have been contacted by MCEQ by letters dated April 2, 2025 and July 21, 2025 and notified of the following alleged violations of the facility’s NPDES Permit:
- Violation of the oil and grease discharge limitations during the December monitoring period in 2024 and during the January and February monitoring periods in 2025.
- Violation of the total suspended solids discharge limitations during the January and February monitoring periods in 2025.
ASI was also contacted my MCEQ by letter dated May 22, 2025 and notified of alleged violations of the industrial stormwater general permit for industrial activities:
- Failure to provide secondary containment for the chemical storage area.
- Failure to implement the storm water pollution prevention plan.
ASI is stated to have submitted an application for a state operating pre-treatment permit and requested that the pretreatment permit to authorize discharge wastewater previously discharged in the NPDES Permit. Further, by letter dated June 5, 2025, ASI submitted to the Mississippi Department of Environmental Quality a list of corrective actions and implemented to return its facility to compliance with the industrial stormwater general permit for industrial activities.
The AO assesses a civil penalty of $17,500.
