The Alabama Department of Environmental Management (“ADEM”) and Raughton Holdings LLC (“RH”) entered into a July 7th Consent Order (“CO”) addressing violations of the ADEM Clean Water Act National Pollution Discharge Elimination System (“NPDES”) Construction Stormwater General Permit (“Permit”).
The CO describes RH as an Alabama developer constructing residential development Raughton Holdings Warehouse ("Facility") in St. Clair County, Alabama.
Sediment and other pollutants in stormwater runoff from the Facility are stated to have or have the potential to discharge and/or have discharged to Roberts Creek. Roberts Creek is described as a water of the State.
An operator is stated to have submitted on June 18, 2024, a notice of intent requesting NPDES coverage under the referenced Permit for regulated disturbance activities and discharges of treated stormwater from the Facility. ADEM granted authorization to the operator on June 18, 2024.
The CO provides that during January 14 and March 26, 2025 inspections, significant accumulations of sediment resulting from discharges at the Facility were observed and documented by ADEM offsite.
A Notice of Violation (“NOV”) is stated to have been sent to the operator on February 4, 2025, requiring a report indicating steps taken at the Facility to correct the noted violations. A response was provided.
The operator neither admits nor denies ADEM’s allegations.
A civil penalty of $25,000.00 is assessed.
