The Mississippi Commission of Environmental Quality and Mississippi Gravel Sales LLC (“MGS”) entered into a November 14th Agreed Order (“AO”) addressing alleged violations of a Mining Storm Water, Dewatering, and No Discharge General Permit (“Permit”).
The AO states that MGS operates a facility in Monroe County, Mississippi.
The Mississippi Department of Environmental Quality is alleged to have contacted MGS on November 3rd, 2015 alleging certain violations at the Monroe County, Mississippi facility. The violations are alleged to include:
- Failure to implement the approved SWPPP in violation of Act 6, Condition S-1 of Mining Storm Water, Dewatering, and No Discharge General Permit No. MSR322425. . .
- Failure to install additional and/or alternative erosion and sediment controls when existing controls prove to be ineffective in preventing sediment from leaving the site in violation of Act 6, Condition S-2(7) of the Permit.
The Mississippi Department of Environmental Quality subsequently determined that MGS corrected the previously referenced violations.
MGS agrees to a civil penalty in the amount of $5,000.
