Storage Tank Enforcement: U.S. Environmental Protection Agency and Keyser, West Virginia Facility Enter into Consent Agreement

The United States Environmental Protection Agency (“EPA”) and Umstott, Inc. (“UI”) entered into a June 11th Consent Agreement (“CA”) addressing alleged violations of the federal and West Virginia underground storage tank (“UST”) regulations. See Docket No. RCRA-03-2026-0196.
The CA provides that UI operates a 7 Eleven facility in Keyser, West Virginia.
The facility is stated to utilize as owner or operator three USTs.
EPA personnel are stated to have conducted an inspection of the facility on June 18, 2024 to determine compliance with Subtitle I of the Resource Conservation and Recovery Act (“RCRA”) and West Virgina UST program. The inspection is stated to have identified the following violations:
- Failure to Conduct Annual Line Tightness Test.
- Failure to Conduct Annual Line Leak Detector Testing.
- Failure to Provide Adequate Spill Prevention.
- Failure to Conduct Annual Release Detection System Testing.
- Failure to Conduct 30-day Release Detection.
- Failure to Conduct 30-day Walkthrough Inspections.
The CA assesses a civil penalty of $30,000.
