The Tennessee Department of Environment and Conservation (“TDEC”) issued a November 5th Order and Assessment (“Order”) to Brockton USA, LLC (“BU”) addressing alleged violations of the Tennessee Underground Storage Tank (“UST”) regulations. See Case No. UST25-0111.
The Order provides that BU is a registered owner of a UST in Ashland City, Tennessee.
The referenced name of the facility is Sudden Service No. 1.
TDEC Division of Underground Storage Tank personnel (“Division”) are stated to have performed a compliance inspection at the facility on March 17th. The inspection allegedly discovered violations that include:
- Failure to conduct monthly monitoring on pressurized piping.
- Failure to monitor tanks at least monthly.
- Failure to keep spill catchment basins free of water, dirt, debris, etc.
- Failure to perform periodic walkthrough inspections.
- Failure to maintain a log of at least the last 12 months of visual inspections for seeps and drips after removing the dispenser cover.
The Order describes correspondence being sent to BU regarding the alleged violations and the company is stated to have not cooperated.
The Order provides that if BU fails to comply or file an appeal within the timeframes that the facility will be placed on the Delivery Prohibition List.
A civil penalty of $16,920.00 is assessed.
