Storage Tank Enforcement: Louisiana Department of Environmental Quality and Thibodaux Motor Fuel Supplier Enter into Settlement Agreement

The Louisiana Department of Environmental Quality (“LDEQ”) and Gaubert Oil Company, L.L.C., (“GOC”) entered into a June 26th Settlement Agreement (“SA”) addressing alleged violations a Notice of Potential Delivery Prohibition (“NOPDP”). See Enforcement Tracking No. UE-PP-22-00495.
GOC is described as a limited liability company that delivers fuel to a retailer of motor fuel located in Morgan City, Louisiana.
An inspection is stated to have been previously conducted at the referenced retail motor fuel facility. An NOPDP was issued for areas of concern noted during the inspection. A red tag is stated to have been placed on the underground storage tank.
GOC is stated to have placed a regulated substance into a UST that LDEQ had red tagged/prohibited from delivery of a regulated substance. This allegation is based on a delivery invoices dated April 4, 2022.
GOC denies it committed any violations or that it is viable for any fines, forfeitures, and/or penalties.
A civil penalty of $1,700 is assessed.
