SPCC/Clean Water Act Enforcement: U.S. Environmental Protection Agency and Galveston County, Texas Facility Enter Into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and GCOWS Operating, LLC (“GCOWS”) entered into a May 14th Expedited Prevention Control and Countermeasure Settlement Agreement (“Agreement”). See Docket No. CWA-06-2025-4312.
The Agreement references a facility operated by GCOWS known as the Maco Stewart facility in Galveston County, Texas.
Total storage capacity of the facility is listed as 178,702 gallons.
Authorized representatives of EPA are stated to have conducted an inspection of the facility on March 12, 2025, to determine compliance with the Oil Pollution Prevention regulations promulgated at 40 CFR Part 112 under Section 311(j) of the Clean Water Act. The Agreement alleges that GCOWS as owner/operator of the facility violated regulations implementing Section 311(j) of the Act by failing to comply with the Oil Pollution Prevention regulations.
The Agreement lists the alleged violations of the SPCC regulations in an appendix.
