OSHA Enforcement: New Jersey Car Wash Cited for Alleged Violations

The Occupational Safety and Health Administration (“OSHA”) issued a September 23rd news release stating that it had cited ModWash LLC (“MW”) for allegedly willfully exposing workers to safety hazards.
OSHA states that MW is an express car wash service operating in multiple locations throughout the country (including 5 in Sicklerville, New Jersey ).
The alleged violations cited include:
- Exposing workers to hazardous energy by failing to lock out equipment prior to conducting maintenance activities and not using energy control procedures.
- Failure to have clear lock out procedures and specific instructions for controlling all energy sources and not training employees on equipment lock out/tag out processes.
- Failure to develop and implement a noise monitoring program.
- Establish a baseline audio program for employees within six months of exposure.
- Train employees exposed to noise above 85 decibels.
OSHA proposes to assess penalties of $446,864.
MW has 15 days from receipt of its citations and penalties to comply, request an informal conference with OSHA, or contest the findings before the independent Occupational Safety and Health Review Commission.
