The Missouri Department of Natural Resources (“MDNR”) and Production Castings, Inc. (“PC”) entered into a June 29th Abatement Order on Consent (“AOC”) addressing alleged violations to the Missouri Clean Water Law (“MCWL”). See Order No. 2026-WPCB-2016.
The AOC describes PC as the owner or operator of a metal fabrication facility in Fenton, Missouri.
MDNR staff are stated to have received an environmental concern reporting a large amount of used oil flowing from a drainage pipe into Saline Creek allegedly originating from the facility. An investigation was conducted in which a large puddle of used oil in a stormwater drain leading to Saline Creek was observed.
U.S. Environmental Protection Agency (“EPA”) staff are stated to have assessed the oil spill and determined approximately 100 to 150 gallons of oil was impacting Saline Creek and that an EPA-lead cleanup would be warranted to address the oil spill. EPA staff and cleanup contractors began oil recovery and removal including flushing the stormwater drain.
EPA staff are stated to have received on September 4, 2025, a concern regarding oil that had reappeared near the stormwater drain resulting in a follow-up on site visit. They are stated to have observed the oil spill and identified the source of the oil as a damaged corrugated pipe coming from the facility.
PC is stated to have confirmed the oil had discharged from the property and signed a Notice of Federal Interest and agreed to hire an environmental cleanup contractor to address the oil spill.
MDNR staff conducted a site inspection on September 8, 2025, with the purpose to:
- Observe the source and cause of the spill as determined by the facility’s investigation.
- Discuss the facility’s responses to date.
- Determine future actions.
Actions undertaken to address these issues were discussed.
The following violations of the MCWL are alleged:
- Causing pollution to waters of the state.
- Operating, using, or maintaining a point source without a No Exposure Certification.
- Failure to apply for renewal of a No Exposure Certification.
A civil penalty of $12,000 is assessed. Further, the AOC requires that PC undertake certain actions pursuant to a timeframe.
