Indirect Discharge/Wastewater Enforcement: Alabama Department of Environmental Management and Jasper Chicken Processing Facility Enter into Consent Order

The Alabama Department of Environmental Management (“ADEM”) and Mar-Jac Poultry AL, LLC (“MJ”) entered into a Consent Order (“CO”) addressing alleged violations of a State Indirect Discharge (“SID”) Permit.
The CO provides that MJ operates a chicken processing facility in Jasper, Alabama.
ADEM is stated to have issued a SID Permit to the facility establishing limitations on the discharges of pollutants from a point source into the Jasper Water Works and Sewer Board, Inc.'s Town Creek Waste Water Treatment Plant.
The SID Permit is stated to require that MJ monitor its discharges daily and weekly and submit monthly Discharge Monitoring Reports ("DMRs") to the Department describing the results of the monitoring. The facility is also required to properly operate and maintain all facilities and systems of treatment and control which are installed or used by the Permittee to achieve compliance with the terms and conditions of the SID Permit.
The CO states that the DMRs submitted to ADEM indicate that the facility has discharged pollutants in violation of the limits imposed by Part I.A of the SID Permit. The alleged effluent violations are listed in Attachment #1 of the CO.
The CO assesses a civil penalty of $75,000. Further, it requires that the facility:
- Submit an Engineering Report that:
- Identifies the potential causes of noncompliance.
- Summarizes an investigation of the changes necessary for the Permittee to achieve and maintain compliance with the SID Permit.
- Outlines a Compliance Plan with a schedule for implementation for necessary corrective actions to comply with all Permit conditions.
- Provide progress reports and certification of compliance.
