Hazardous Waste Enforcement: U.S. Environmental Protection Agency and San Juan Grocery Chain Pharmacy Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and Kroger Specialty Pharmacy 5-60 (“Kroger”) entered into a July 29th Expedited Settlement Agreement and Final Order (“Agreement”) addressing an alleged violation of the Resource Conservation and Recovery Act regulations. See Docket No. RCRA-02-2026-7204.
The Agreement provides that Kroger is the owner or operator of the Kroger Specialty Pharmacy 5-60 in San Juan, Puerto Rico.
EPA is stated to have conducted review of e-manifest data of hazardous waste shipments from this facility and had discussions with Kroger regarding its findings.
The Agreement provides that EPA determined that Kroger failed to have an EPA identification number prior to transporting or offering for transport hazardous waste from its facility. The Agreement further provides that during the years 2023-2025, Kroger shipped hazardous waste from its Facility using hazardous waste manifests without having received an EPA identification number in violation of 40 C.F.R. § 262.18(a).
Kroger neither admits nor denies the allegations contained in the Agreement.
A civil penalty of $1,250 is assessed.
