Hazardous Waste Enforcement: Louisiana Department of Environmental Quality and Oakdale Food Flavoring Manufacturing Facility Enter into Settlement Agreement

The Louisiana Department of Environmental Quality (“LDEQ”) and Byrne Callahan Legacies, LLC f/k/a Natural Advantage, LLC (“NA”) entered into an August 31st Settlement Agreement (“SA”) addressing alleged violations of the Louisiana hazardous waste regulations. See Settlement Tracking No. SA-HE-25-0039.
The SA provides that NA owns and/or operates a food flavoring manufacturing facility in Oakdale, Louisiana.
LDEQ is stated to have conducted an inspection at the facility on December 9, 2021, to determine compliance with the hazardous waste regulations. The inspection allegedly identified the following violations:
- Failure to label containers accumulated hazardous waste during storage at/or near the point of generation where the waste initially accumulated with the words “Hazardous Waste” and with an indication of the hazards of its contents.
- Failure to clearly label containers of hazardous waste with the date upon which each period of accumulation began.
- Failure to ensure that container storage areas have containment systems which are designated and operated in accordance with the relevant regulations.
- Failure to develop and implement a waste minimization plan.
- Failure to conduct at least weekly inspections of central accumulation areas of hazardous waste.
- Failure to ensure personnel involved in hazardous waste management complete an annual review of the initial training.
NA denies it committed any violations or that it is liable for any fines, forfeitures, and/or penalties.
A civil penalty of $13,500 is assessed. Further, NA is required to undertake within certain timeframes actions to remedy any remaining alleged violations.
