Federal Insecticide, Fungicide, and Rodenticide Act Enforcement: U.S. Environmental Protection Agency and Torrington, Wyoming Cooperative Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and Western Cooperative Company (“WCC”) entered into a June 11th Expedited Settlement Agreement (“ESA”) addressing an alleged violation of the Federal Insecticide, Fungicide, and Rodenticide Act (“FIFRA”). See Docket No. FIFRA-08-2026-0091.
The ESA provides that WCC is a producer operating a registered pesticide-producing establishment.
EPA is stated to have conducted an inspection at the WCC facility on September 9, 2025. The inspection is stated to have determined that WCC had not produced any pesticides or devices during reporting year 2024. Nevertheless, the ESA states that on its annual report, WCC reported production. As a result, the ESA alleges that WCC submitted an inaccurate form for reporting year 2024 by failing to report zero production.
The alleged failure to comply with section 7(c) of FIFRA is stated to constitute a violation of section 12(a)(2)(L) of FIFRA.
The ESA assesses a civil penalty of $1,000.
