The Federal Energy Regulatory Commission (“FERC”) in an August 13th Federal Register notice announced the availability of a final version of a guidance document titled:
Energy Guidelines for the Evaluation of Hydropower Projects: Chapter 12 – Water Conveyance (“Guidelines”)
See 83 Fed. Reg. No. 40034.
The Guidelines are stated to reflect the “most current thinking and practices” of the Division of Dam Safety Inspections. However, while providing guidance to industry, they are specifically stated to not be a substitute for, amend, or supersede FERC’s regulations under the 18 C.F.R. part 12 – Safety of Waterpower Projects and Project Works.
