Data Centers/Gas-Fired Power Plant: Sierra Club/Public Citizen File Citizen Suit Action Addressing San Antonio, Texas Project

Sierra Club and Public Citizen (“Sierra Club”) filed a September 21st Clean Air Act citizen suit Complaint against the following corporations:
- VANTAGE DATA CENTERS
- MANAGEMENT COMPANY, LLC
- VANTAGE DATA CENTERS TX11, LLC
- VANTAGE DATA CENTERS TX21, LLC
- VOLTAGRID LLC
(Collectively, “VDC”).
The companies are stated to be involved in constructing two gas-fired power plants to power two San Antonio, Texas data center campuses.
The gas-fired power plants are referenced as 405 megawatts with diesel-fired backup generation of 455 megawatts.
The Complaint alleges that the projects obtained Minor Source Permits from the Texas Commission on Environmental Quality. They further allege that Minor Source Permits were obtained because each data center and each co-located power plant were stated to be separate sources of emissions, therefore falling below Major-Source thresholds.
The Complaint alleges the following claims:
- Vantage Data Centers Management Company, LLC and Vantage Data Center TX11, LLC Circumvented New Source Review Preconstruction Permitting Requirements at the Omicron Drive Data Center Campus.
- Vantage Data Centers Management Company, LLC and Vantage Data Center TX21, LLC Circumvented New Source Review Preconstruction Permitting Requirements at the Rogers Road Data Center Campus.
- Unauthorized Construction and Operation of the Omicron Drive Campus Without a Nonattainment New Source Review Permit for Ozone Precursors.
- Unauthorized Construction and Operation of the Rogers Road Campus Without a Nonattainment New Source Review Permit for Ozone Precursors.
- Unauthorized Construction and Operation of the Omicron Drive Campus Without a PSD Permit for Carbon Monoxide.
- Unauthorized Construction and Operation of the Rogers Road Campus Without a PSD Permit for Carbon Monoxide.
- Operation of the Rogers Road Diesel Back-Up Generators in Violation of the Clean Air Act, Texas SIP, and Minor-Source Authorization.
