The Environmental Project, Sierra Club, and public citizen (Collectively “EIP) sent a July 22 Clean Air Act Notice of Intent letter (NOI) to the following corporations:
- Vantage Data Centers (Collectively “Vantage”)
- VoltaGrid, LLC (VoltaGrid)
Vantage and VoltaGrid are stated to be involved in constructing two gas-fired power plants to power two San Antonio, Texas, date center campuses. The gas-fired power plants are referenced as 423 megawatts along with 454 megawatts of diesel-fired backup generation.
The NOI states that the projects obtained minor source permits from the Texas Center of Environmental Quality. They further allege that minor source permits were obtained because each date center and each co-located power plant were stated to be separate sources of emissions therefore falling below major-source thresholds.
The NOI further alleges in part:
- The data centers do not fall below major-source Clean Air Act thresholds because they were allegedly using a “piecemeal approach to Clean Air Act permitting to fast-track these projects.”
- Scope of the projects and their emissions have grown since the initial minor source permit approvals.
The NOI further alleges:
- Unauthorized construction of the Rogers Road campus without a major source Clean Air Act preconstruction permit for ozone and CO, is in violation of the Clean Air Act and the Texas State of Limitation plan.
- Operation of the date centers facilities’ diesel-fired generators at the Rogers Road campus is in violation of the minor source permit.
