The Oregon Department of Environmental Quality (“ODEQ”) issued a June 25th Notice of Civil Penalty Assessment and Order (“Notice”) to FourThreeSeven Management, LLC (“FTSM”) addressing alleged violations of air and hazardous waste regulations. See Case No. AQ/ACDP-NWR-2025-626.
The Notice states that FTSM operates a cannabis extracts manufacturing business in Milwaukie, Oregon.
The facility is stated to have begun manufacturing in 2021 using a process which includes using solvents to extract cannabis concentrates, and these solvents emit volatile organic compounds (“VOCs”). Further, the facility is stated to have a capacity to emit 10 or more tons per year of VOCs.
FTSM is stated to have submitted an Air Contaminant Discharge Permit application to ODEQ on August 4, 2025. As of the date of the Notice, ODEQ is stated to have not issued an Air Contaminant Discharge Permit to the facility.
An inspection of the facility is stated to have taken place on March 28, 2024, and in terms of alleged hazardous waste violations, the following were identified:
- Failure to make a hazardous waste determination on stockpiled biomass or new biomass.
- Generation of over 220 pounds of waste cannabis biomass containing solvents and Trichloroisocyanuric acid and did not make or document a complete and accurate hazardous waste determination at the point of generation.
- Placement of biomass in an open container under a large fan to evaporate the remaining solvents from biomass post-extraction, in order to change the physical, chemical, or biological character or composition of the waste and render the waste non-hazardous, safer to transport, store, or dispose of, or reduced in volume.
- Storage of hazardous waste outdoors in garbage bags, some of which had been tom and were open to the elements.
The Notice proposes a civil penalty of $46,631.
