Air Enforcement: U.S. Environmental Protection Agency and Pueblo, Colorado Gasoline Dispensing Facility Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and CF Altitude L.L.C. (“CF”) entered into a June 8th Expedited Settlement Agreement (“ESA”) addressing an alleged violation of the Clean Air Act regulations. See Docket NO. CAA-08-2026-0005.
The ESA provides that CF operates a gasoline dispensing facility in Pueblo, Colorado.
The facility is stated to be subject to 40 C.F.R. Part 63, Subpart CCCCCC, §§ 63.11110 through 11132, "National Emission Standards for Hazardous Air Pollutants for Source Category: Gasoline Dispensing Facilities.”
The facility is stated to have exceeded the gasoline throughput of 100,000 gpm on or before October 1, 2021, and is therefore subject to certain control requirements. Further, the facility is stated to have been required to install and initially test a vapor balance system which meets the requirements of C.F.R § 63.11118 and 0 C.F.R. § 63.11120 no later than October 1, 2024.
The ESA assesses a civil penalty of $19,133.
