The Tennessee Air Pollution Control Board (“Board”) issued a May 5th Proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Covia Solutions, LLC (“Covia”) addressing alleged violations of an Air Permit. See Case No. APC26-0060.
The Order provides that Covia was issued a Conditional Major Source Operating Permit on February 7, 2024, for a silica sand handling/drying operation.
The Tennessee Division of Air Pollution Control is stated to have received Covia’s New Source Performance Standards 40 CFR Part 60 Subpart UUU – Standards of performance for Calciners and Dryers in Mineral Industries semiannual report for the reporting period of July 1 to December 31, 2025 by certain Conditions of the Air Permit. The Division is stated to have received the report 11 days after the January 31, 2026 due date. This is alleged to have violated Conditions S1-4 and S2-4 of the Permit.
The Order proposes a civil penalty of $2,250.
