The Tennessee Air Pollution Control Board (“Board”) issued a Proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Buffalo River Truss LLC (“BRT”) addressing an alleged violation of the Tennessee air regulations. See Case No. APC25-0128.
The Order provides that BRT operates a steel truss and joist manufacturing facility.
A Conditional Major Source operating permit is stated to have been issued to the facility on October 23, 2024.
Condition Fl-10.(1)(iii) of the permit requires that the permittee prepare and submit annual certification and compliance reports for each affected source according to the requirements of paragraphs (1) through (3) of this condition.
The Tennessee Division of Air Pollution Control is stated to have received an annual certification and compliance report from BRT on March 5. The submission is stated to have been 33 days late. Therefore, the facility is stated to have violated the previously referenced condition of the permit.
A civil penalty of $1,500.00 is proposed.
The Order provides certain appeal rights.
