The Tennessee Air Pollution Control Board (“Board”) issued on September 2nd a Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Southern Ionics Inc. (“SII”) addressing alleged violations of an Air Permit. See Case No. APC 25-0030.
The Order provides that SII operates a facility in Calhoun, Tennessee for the manufacture of:
…aluminum sulfate and magnesium sulfate operation, consisting of a reactor, clarifier, filters, and chemical storage tanks.
The Technical Secretary is stated to have issued in 2010 a True Minor operating permit. The operating permit is stated to have a condition that states:
…Total sulfur dioxide emitted from this source shall not exceed 0.22 pounds per hour.
The Tennessee Division of Air Pollution Control is stated to have received SII’s updated permit renewal on August 26, 2024. Division personnel determined after reviewing a stack test report that the facility had emitted an average of 3.09 pounds per hour of sulfur dioxide, exceeding the previously referenced limit. Further, the stack test report is stated to have indicated that an average of 0.62 pounds per hour of hydrogen chloride had also been emitted.
SII’s permit application is stated to have not notified the Division of Air Pollution Control that hydrogen chloride would be emitted at the facility.
The Order assesses a civil penalty of $3,000.00.
SII is provided certain appeal rights.
