Air Enforcement: Tennessee Air Pollution Control Board Order/Assessment of Civil Penalty Addressing South Pittsburg Rock Crushing and Sizing Facility

The Tennessee Air Pollution Control Board (“Board”) and H&H Stone LLC (“HH”) entered into a December 18, 2025, Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) addressing an alleged violation of an Air Permit. See Case No. APC25-0182.
HH operates a quarry in South Pittsburg, Tennessee.
The Tennessee Division of Air Pollution Control (“Division”) is stated to have received HH’s construction permit application on August 27, 2025, requesting to add certain non-metallic mineral crushing and sizing equipment to its existing rock crushing and sizing operation. The list of equipment is found in Paragraph VII of the Order.
The application is stated to have indicated that the modification started on July 2 and was completed on July 10, 2025. Further, HH is stated to have conducted on July 22, 2025, 19 EPA Method 9 Visible Emission Evaluation for the crushing and sizing operation which included the referenced equipment. The Order therefore states that HH constructed and operated the equipment prior to applying for and receiving the required permits.
The Order Assesses a Civil Penalty of $4,500.
