Air Enforcement: Oregon Department of Environmental Quality Notice of Civil Penalty Assessment Addressing Tualatin and Hillsboro Gasoline Dispensing Facilities

The Oregon Department of Environmental Quality (“ODEQ”) issued a February 20th Notice of Civil Penalty Assessment and Order (“Notice”) to United Parcel Service, Inc. (“UPS”) addressing an alleged violation of Oregon air regulations. See No. AQ-ACDP-NWR-2024-067.
The Notice provides that UPS operates gasoline dispensing facilities in Tualatin, Oregon and Hillsboro, Oregon.
The facilities are stated to used underground gasoline storage tanks that are equipped with a stage I vapor balance system intended to capture vapors while transferring gasoline from tanker trucks and storage trucks.
All gasoline dispensing facilities with a monthly throughput of 10,000 gallons or more are required to obtain a general Air Contaminant Discharge Permit (“ACDP”). The referenced UPS facilities are stated to have an average monthly throughput of 10,000 gallons or more. Therefore, ODEQ is stated to have assigned UPS coverage under the general ACDP.
The Notice states that UPS has not submitted required annual reports for the 2023 calendar year for either of the referenced facilities violating Condition 11.4 of the Permit.
A civil penalty of $1,650.00 is assessed.
