Air Enforcement: New Mexico Environmental Department Notice of Violation for Los Lunas Area Pit Crusher Operator

The New Mexico Environment Department (“NMED”) issued an October 29th Notice of Violation (“NOV”) to Black Rock Services, Inc. (“BR”) for alleged violations of the New Mexico air regulations. See BRS-36610-2501.
The NOV provides that BR operates a pit crusher west of Los Lunas, New Mexico.
The facility is stated to operate pursuant to a General Construction Permit (“GCP”).
An NMED air quality inspector is stated to have undertaken inspection of the BR facility on October 30, 2024. Further, correspondence is stated to have been undertaken with facility staff through December 2024. The investigation is alleged to have found evidence of the following violations of the facility’s GCP:
- Failure to implement a startup, shutdown, and maintenance (“SSM”) plan pursuant to 20.2.7.14 NMAC (BR is stated to have submitted a plan to NMED on December 6, 2024).
- Failure to maintain a copy of the registration form, GCP permit, and approval letter at the Facility pursuant to GCP-2-6770, Section III.A.5 (BR is stated to have sent a memo to NMED on April 22nd stating the violation had been corrected.
- Failure to maintain monthly opacity records from September 2022 to October 2024 pursuant to GCP-2-6770, Section IV.B.2.
- Failure to perform daily inspections of water sprays on each operating day pursuant to GCP-2-6770, Section IV.A.2.
- Failure to submit notification to the department 15 days prior to addition/substitution of equipment pursuant to GCP-2-6670, Section IV.C.1.d.
BR is stated to have sent NMED a memo on April 22nd with a bulleted list of corrective actions taken by the company at the Facility since the September 13, 2022, inspection. However, NMED requests additional information.
