Air Enforcement: Mississippi Commission on Environmental Quality and Magnolia Railway Services Facility Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Southeastern Railway Services (“SRS”) entered into a January 5th Agreed Order (“AO”) addressing alleged violations of an Air Permit. See Order No. 7646 26.
The AO provides that SRS operates a railway services facility in Magnolia, Mississippi.
The facility is stated to operate pursuant to a Synthetic Minor Operating Permit (“Permit”).
The following alleged violations are stated to have occurred:
- Unpermitted fuel storage tank in violations of Condition 1.A.11 of the Permit.
- Failure to conduct and record monthly maintenance records in violation of Condition 5.4 of the Permit.
- Failure to monitor and record hours of operation in violation of Condition 5.5. of the Permit.
- Failure to submit Synthetic Minor annual reports for calendar years 2022 and 2023 in violation of Condition 6.2 of the Permit.
SRS is stated to have:
- Submitted the annual monitoring reports for the referenced calendar years.
- Submitted documentation showing the unpermitted fuel storage tank had been removed from the facility.
A $4,500 penalty is assessed.
