The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and Drew Foam Companies Inc. (“DF”) entered into a January 30th Consent Administrative Order (“CAO”) addressing an alleged violation of an Air Permit. See Case #: CAO-25-0068.
The CAO provides that DF operates a polystyrene foam product manufacturing facility located in in Monticello, Arkansas.
The facility is stated to operate pursuant to a Clean Air Act Title V Permit.
ADEQ is stated to have performed compliance evaluation inspection at the facility on April 16, 2025, covering the reporting period of April 1, 2023, through March 31, 2025.
DF is stated to have provided ADEQ a written response to the inspection on July 3, 2025 regarding actions to correct the alleged noncompliance item. The company stated that non-resettable hour meter on the Briggs and Stratton Generator (SN-15) had been installed. Further, DF submitted pictures to ADEQ of the non-resettable hour meter installed on SN-15.
The CAO alleges a failure to comply with a delegated NESHAP requirement (8 CAR § 41-204 and 40 C.F.R. Part 63). The inspection is stated to have discovered that DF failed to install a non-resettable hour meter on SN-15. Failing to install a non-resettable hour meter on SN-15 is alleged to be a violation of Specific Condition 14 of the Air Permit.
The CAO assesses a civil penalty of $4,800.
