The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and Stella-Jones Corporation (“SJC”) entered into a May 21st Consent Administrative Order (“CAO”) addressing alleged violations of an Air Permit. See LIS No. 25-048.
The CAO provides that SJC owns and operates a wood utility pole yard in Grant County, Arkansas.
The facility is stated to hold an Air Permit.
DEQ is stated to have conducted an inspection on May 17, 2024, with the inspection reporting period of December 2022 through April 2024.
The inspection is stated to have determined that a review of DEQ’s 2019 Compliance Monitoring Database found that the facility failed to timely submit two Semi-Annual Monitoring (“SAM”) Reports that were due on or before August 1, 2023, and February 1, 2024. On August 2, 2024, the August 1, 2023 SAM report was received by DEQ and on August 14, 2024, the February 1, 2024 SAM report was delivered to DEQ. These are alleged to violate General Provision 7 of the Air Permit.
The inspection has also determined that a review of the DEQ Annual Compliance Certification (“ACC”) database found that SJC failed to submit the ACC Report that was due on or before the February 1, 2024 deadline. The Report is stated to have been received by DEQ on August 14, 2024, violating General Provision 21 of the Air Permit.
SJC neither admits nor denies the factual and legal allegations contained in the CAO.
A civil penalty of $4,800.00 is assessed.
