The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and Covia ISP, Inc. (“Covia”) entered into a March 11th Consent Administrative Order (“CAO”) addressing an alleged violation of a Clean Air Act Title V Permit. See Case #: CAO-25-0106.
The CAO provides that Covia operates an industrial sand mining facility located in Fort Smith, Arkansas.
The facility is stated to operate pursuant to a Clean Air Act Title V Permit.
On July 22, 2025, ADEQ is stated to have conducted an air compliance evaluation at the facility covering the reporting period of June 1, 2024, through May 31, 2025.
On August 21, 2025, Covia provided a report to ADEQ regarding the actions taken to correct the non-compliance items including required maintenance being completed at the 2.135 MMBtu/hr Emergency Generator on July 30, 2025.
The CAO provides that during the inspection it was discovered that Covia failed to conduct the required annual maintenance at SN-73A during 2024. Failing to perform the annual maintenance on SN-73A is stated to be a violation of Specific Condition 28 of the Permit and 40 C.F.R. Part 63, Subpart ZZZZ.
The CAO assesses a civil penalty of $5,600.
