Air Enforcement: Alabama Department of Environmental Management and Munford Real Property Owner Enter into Proposed Administrative Order

The Alabama Department of Environmental Management (“ADEM”) and Holmes II Excavation, Inc. (“Holmes”) entered into a November 5th Proposed Administrative Order (“PAO”) addressing alleged violations of the Alabama air regulations. See PROPOSED ADMINISTRATIVE ORDER NO: 25-XXX-AP.
The PAO provides that Holmes owns real property in Mumford, Alabama.
ADEM is stated to have received a complaint alleging unauthorized open burning on July 23rd. Further, during a July 29 site inspection, ADEM personnel are stated to have been informed by Holmes personnel that they burn plywood, 2x4s and other scrap material from a nearby oriented strand board (“OSB”) manufacturer.
A Notice of Violation is stated to have been sent to Holmes on August 9th and a written response received from the real property owner on August 25th. Holmes is stated to have admitted to burning scrap lumber and/or pallets.
The Holmes burning on the real property is stated to have not met all the conditions of ADEM Administrative Code.
The PAO assesses a civil penalty of $4,000.00.
