The Alabama Department of Environmental Management (“ADEM”) and Home Oil Company, Inc. (“Home”) entered into a Consent Order (“CO”) addressing an alleged violation of the Alabama Air regulations.
The CO provides that Home is the owner and/or operator of a bulk gasoline plant in Houston County, Alabama.
The bulk plant is stated to operate pursuant to an ADEM Air Permit issued in 1992. The Permit authorizes the operation of a bulk plant, subject to certain limitations and conditions.
ADEM personnel are stated to have conducted an inspection of the bulk plant on April 2nd. The inspector observed rocks wedged into the poppet valves on both outgoing vapor recovery ports. As a result, vapors were freely venting into the atmosphere.
ADEM issued a Notice of Violation to Home on April 30th for wedging rocks into the poppet valves, letting vapors vent into the atmosphere.
Home’s response to Notice of Violation stated that the rocks were wedged into the poppet valves due to a new driver on a spare tanker that was not equipped with the proper equipment to reach the vent.
Home neither admits nor denies ADEM’s contentions.
A civil penalty of $7,200.00 is assessed.
