The United States Environmental Protection Agency (“EPA”) has published in the April 21st Federal Register notice of the issuance of the document titled:
Forty-Seventh Update of the Federal Agency Hazardous Waste Compliance Docket (“Notice”).
See 90 Fed. Reg. 16674.
Section 120(c) of CERCLA requires the EPA to establish the Federal Agency Hazardous Waste Compliance Docket (“Docket”). See 42 U.S.C. 9620(c).
The Docket is intended to provide information on federal facilities that manage hazardous waste. The information is accumulated through federal agencies’ submission to EPA under Sections 3005, 3010, and 3016 of the Resource Conservation and Recovery Act.
The Docket also contains information on federal facilities for which a reportable quantity of hazardous substance has been released. This information is submitted by the federal agencies to EPA pursuant to Section 103 of CERCLA. See 42 U.S.C. 9603.
EPA states that the Docket has three major purposes:
- To identify all Federal facilities that must be evaluated to determine whether they pose a threat to human health and the environment sufficient to warrant inclusion on the National Priorities List (NPL);
- To compile and maintain the information submitted to EPA on such facilities under the provisions listed in section 120(c) of CERCLA; and
- To provide a mechanism to make the information available to the public.
The Federal Register preamble includes a discussion of the additions, deletions, and corrections to the list of Docket facilities since the previous Docket update. Also addressed are the following:
- Process for Compiling the Updated Docket.
- Facilities Not Included.
- Facility National Priority List Status Reporting, Including NFRAP Status.
- Information Contained on Docket Listing.
