The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and INTERFOR U.S. INC. (“IUI”) entered into a June 24th Consent Administrative Order (“CAO”) addressing alleged violations of an Air Permit. See Case #: CAO-25-0070.
The CAO provides that IUI owns and operates a lumber yard in Monticello, Arkansas.
The facility is stated to operate pursuant to a Title V Air Permit.
ADEQ is stated to have performed a compliance evaluation of the facility covering the reporting period of October 1, 2022, through April 30, 2025.
The facility, on August 7, 2025, stated to ADEQ:
- Respondent has hired a new EHS coordinator who is being trained on the compliance and recordkeeping requirements of the Title V Permit and Dust Management Plan (DMP). Records will be maintained going forward.
- Lack of visible emissions readings and recordkeeping was due to loss of EHS personnel for an extended period. Once Respondent identified that weekly visible emission readings were not being performed, two employees were certified to read Method 9 visible emissions, and weekly monitoring and recordkeeping activities recommenced. Further, Respondent has since hired a new EHS Coordinator who is being trained to oversee this requirement. Readings will be taken and records retained going forward.
The CAO identifies the following alleged violations:
- Failure to meet record keeping or reporting conditions that are for enforcement of a criteria pollutant emission limit.
- Failure to provide the daily dust control records required by the Dust Management Plan violating Specific Condition 20 of the Permit.
The facility is required to demonstrate compliance with Specific Conditions 4 and 12 and shall submit weekly opacity records for six consecutive months beginning with the month following the effective date of the CAO. Further, it must demonstrate compliance with Specific Condition 20 of the Permit by submitting daily dust control records for six consecutive months beginning with the month following the effective date of the CAO.
The CAO assesses a civil penalty of $12,000.
