Air Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and City of Dardanelle Enter into Consent Administrative Order

The Arkansas Department of Energy and Environment - Division of Environmental Quality (“ADEQ”) and the City of Dardanelle, Arkansas entered into a March 30th Consent Administrative Order (“CAO”) addressing alleged violations of an air permit. See Case #: CAO-25-0028.
The CAO provides that Dardanelle owns and operates an air curtain incinerator (“ACI”) located in Yell County, Arkansas.
Dardanelle operates the ACI pursuant to an Air General Permit For Title V Air Curtain Incinerators (“Permit”).
ADEQ is stated to have performed a compliance evaluation of the ACI on January 17, 2025. The compliance evaluation covered the reporting period of October 1, 2024 through December 1, 2024.
ADEQ received Dardanelle’s written response on February 12, 2025 regarding the actions taken to correct the non-compliance items. Dardanelle is stated to have submitted all required records.
The CAO lists the following violations:
- Failure to timely submit General Provision 7 recordkeeping report.
- Failure to timely submit General Provision 21 recordkeeping report.
A civil penalty of $3,000 is assessed.
