“What role do states play in protecting data rights?”
Attorney Anton Janik: If you're gathering data about your customers, you have duties with that data. So I think the big question for these companies is to keep in mind that the laws that apply to them with regard to this data collection and data use are actually the laws of the states where the data rights subjects are resident. It's not the state of residency of the company, and therefore they really need to be looking at this in a broad based manner.
Because the law is changing through 51 jurisdictions on a regular basis, and maybe someday at the federal level, we really need clients to remain apprised of those changes of law and have their own procedures and policies adjusted to take into account those new changes.
