Disability Leave, Compliance and Litigation

Mitchell Williams helps clients to understand and navigate a complex web of disability, leave, and health management issues to assure that employers are in compliance with applicable laws and regulations.  We advise clients regarding their obligations under FMLA, ADA, GINA, HIPAA, COBRA, ERISA, and USERRA and other federal statutes, as well as applicable state and local laws and regulations.

Our aim always is to help employers promote employee health, safety and wellness, decrease the costs associated with under-productive and absent employees, help contain health-care-related expenses, and reduce the risk of litigation.

We counsel employers on how to integrate legal obligations with company policies, programs, and procedures.  We provide advice on:

  • Leave and attendance policies

  • Management guidelines to assist in administering and integrating leave and benefit programs in compliance with federal and state laws

  • Training on disability and absence-management compliance obligations

  • Template forms and letters used to administer leaves of absence and to process reasonable accommodation requests

  • Individual leave and accommodation issues

In addition, our attorneys defend employers against legal challenges to disability management decisions before courts and administrative agencies.
