The Arkansas Oil Marketers Association recently notified its members that it had received information that the Federal Environmental Protection Agency ("EPA") will be conducting Clean Water Act Spill Prevention Control and Counter Measure ("SPCC") inspections at various Arkansas facilities to tanks during the month of January. EPA will also apparently be providing outreach to farmers, marinas and bulk plant operators that utilize above-ground storage tanks. The Clean Water Act SPCC regulations for tanks containing oil are one of the few environmental programs that the Federal EPA has and continues to primarily enforce in the state of Arkansas. The penalties assessed by Federal EPA are often several times larger than those issued by many states including Arkansas. It may well be advisable to ensure that if you have facilities subject to the rules have up-to-date SPCC plans and any required revisions in view of the changes to the regulations of the last few years.
