Ben Brenner is a member of the Litigation Practice Group with significant arbitration and trial experience. Mr. Brenner focuses his practice in the area of large scale products liability including MDL proceedings; real estate and construction contract and defect cases; business tort cases; and other complex commercial litigation.


  • Works as part of defense, bellwether selection, and trial teams in products liability MDL proceedings against medical device and pharmaceutical companies.
  • Representation of owners and developers in claims against general contractor, engineers, and subcontractors for breach of construction contract, failure to properly design and install mechanical, electrical, and plumbing systems (including HVAC), and construction defects, including trial and arbitration proceedings.
  • Successful defense of complicated mold and premises liability claims brought by multiple plaintiffs against owner and developer of multi-family housing development.
  • Successful defense and prosecution of materialmen’s and mechanics liens.
  • Representation of a national retailer in the investigation and prosecution of over a million dollars of employee theft and fraud.
  • Defense of clients under investigation for violation of overtime regulations by the U.S. Department of Labor and defense of collective actions under the Fair Labor Standards Act.
  • Defense and prosecution securities fraud and breach of fiduciary claims against LLC members and managers, and other corporate officers.
  • Representation of large hospital in medical malpractice cases.
  • Advises corporate clients on employment policies and procedures regarding social media, employee handbooks and EEOC investigations, internal investigations, succession planning, and significant real estate acquisitions and projects.
