The United States Environmental Protection Agency (“EPA”) and Richard Devereaux, North Portland Express Care (“Express Care”) entered into an August 3rd Consent Agreement (“CA”) addressing alleged underground storage tank (“tank”) regulation violations. See DOCKET NO. RCRA-10-2016-0104.
The referenced individual is stated to be the owner of three tanks at North Portland Express Care located in Portland, Oregon.
The Express Care facility is stated to utilize three tanks which routinely contain either motor oil or used motor oil. Such motor oil are types of “petroleum” and regulated substances under Oregon’s Storage tank Regulations.
The CA alleges the following violations for the tank systems:
- Failure to Conduct Release Detection for UST Systems
- Failure to Operate and Maintain Corrosion Protection
- Failure to Maintain Financial Responsibility
- Failure to Provide Overfill Prevention
- Failure to Provide Operator Training
The CA provides that the previously referenced individual neither admits nor denies the specific factual allegations contained in the CA.
The CA assesses a civil penalty of $16,407.
