The Alabama Department of Environmental Management (“ADEM”) and PTS Worldwide, Inc. (“PTS”) entered into an Order alleging violations related to the transportation of hazardous waste. See ORDER NO. 17-XXX-HW.
PTS is described as a transportation company that:
. . .specializes in cargo security operating in Anniston, Calhoun County, Alabama under USDOT No. 1835664, whose corporate offices are located at 115 East DeKalb Street in Somonauk, DeKalb County, Illinois. At all times relevant to these findings, PTS was an unpermitted, non-rail hazardous waste transporter.
The Anniston Army Depot (“ANAD”) is stated to have notified ADEM on January 19, 2016 and November 18, 2015, it shipped hazardous waste ammunition to EBV Explosives Environmental Company in Carthage, Missouri using PTS as the hazardous waste transporter. PTS is alleged to not have an Alabama Hazardous Waste Transport Permit or an Environmental Protection Agency Identification Number.
ANAD was issued a Notice of Violation by ADEM on January 26, 2016 for allegedly shipping waste ammunition to EBV Explosives Environmental Company (“EEC”) in Carthage, Missouri via PTS. PTS is further alleged to not have had a valid EPA Identification Number or an Alabama Hazardous Waste Transporter Permit.
Order (Order NO. 17-XXX-HW) states that ADEM Admin. Code r. 335-14-14-.01(2)(c) provides that a non-rail transporter must not transport hazardous waste without having received an Alabama Hazardous Waste Transport Permit in compliance with Rules 335-14-8-.09 through 335-14-8-.13. It further alleges that according to hazardous waste manifest number 002708374 JJK, on November 18, 2015 PTS transported approximately 21,000 pounds of waste cartridges for weapons (D003, D007, and D020) generated by ANAD (EPA Identification No. AL3210020027) in Anniston, AL to EBV – EEC (EPA Identification No. MOD98578164) without having received an Alabama Hazardous Waste Transport Permit in compliance with Rules 335-14-8-.09 through 335-14-8-.13
The Order assesses PTS a civil penalty of $5,000.
