The Alabama Department of Environmental Management (“ADEM”) has issued an Order to Five Points Grocery & Tires, L.L.C. (“FPGT”) addressing alleged violations of the certain Alabama regulations related to management of scrap tires. See Order No. 16-XXX-ST.
The Order states that FPGT is a registered Class One Scrap Tire Receiver facility located in Lawrence County, Alabama.
The Order provides that ADEM personnel conducted an inspection of the FPGT facility on August 13, 2015 to determine compliance with Division 4 of the ADEM Administrative Code. Violations allegedly documented included:
- The FPGT facility exposed scrap tires to the elements for more than 30 days and failed to develop and implement a Vector Control Plan.
- FPGT failed to submit a quarterly report for the April-June 2015 reporting period addressing previous quarter activities utilizing ADEM form 539.
The Order assesses civil penalty of $3,750.00.
