The Missouri Department of Natural Resources (“MDNR”) issued a July 19th Notice and Order to Abate Violations and Pay Administrative Penalties (“Order”) to Turner Scrap Metal & Mobile Home Salvage (“Turner”) addressing alleged violations of the Missouri Clean Water Law (“MCWL”).
The Order describes Turner as a solid waste recovery facility in Bevier, Missouri that recycles metal and materials from mobile homes.
Stormwater from the facility’s salvage yard operation is stated to discharge into a tributary to Middle Fork Chariton River. A Missouri State Operating Permit (“Permit”) was issued by MDNR to the facility. However, the Order states that the Permit expired by its own terms on July 23, 2014 and Turner had not submitted an application to renew the Permit by the date of the Order.
MDNR staff is stated to have conducted inspections of the Turner facility on September 16, 2015 and February 17, 2016 and documented and/or observed:
- Several piles of assorted material on the property, along with several trailers and platforms with siding and other materials
- Piles of wood, debris from the road which appeared to be demolished mobile homes
- Five vehicles, a travel trailer and a mobile home
MDNR issued Notices of Violation on October 14, 2015 and March 1, 2016 for allegedly operating a water contaminant source without a permit.
The Order alleges that Turner violated the MCWL and its implementing regulations:
Since July 23, 2014, operated, used or maintained a water contaminant source – a metal collection and mobile home salvage operation – which intermittently discharges to a tributary to Middle Fork Chariton River, waters of the state, without an MSOP, in violation of Sections 644.051.2, 644.076.1, RSMo, and 10 CSR 20-6.200(1)(A).
The Order requires that Turner submit to MDNR a Form-E- Application for General Permit and a map of the site showing the property boundaries in relation to the adjacent waterways and outfalls to renew MSOP No. R 8OH108 and the applicable permit fees. Further, within 90 days of the issuance of the Order, Turner must develop and submit to MDNR, a Stormwater Pollution Prevention Plan for the site which incorporates site-specific practices to best minimize the discharge of pollutants as required by the Permit.
The Order assesses a penalty of $2,120.00.
